A proposed class lawsuit alleging that defective transmissions in certain Honda Civics models made it difficult for drivers to tell when parking brakes were properly engaged might proceed in federal court after all.
The U.S. Court of Appeals for the Ninth Circuit affirmed on Tuesday a district court ruling dismissing class claims brought under the Magnuson-Moss Warranty Act, but it concluded that the lower court erred in dismissing the drivers’ state-law claims.
